PROBATE ADMINISTRATION

Few experiences are as painful as losing someone you love. During a time of grief, families are often faced with the added responsibility of handling the legal and financial matters associated with administering a loved one’s estate. When this process is supervised by the court, it is known as probate.

In Michigan, the Probate Court oversees both relatively simple estates and more complex matters that require ongoing court involvement. Whether an estate is straightforward or complicated, working with an experienced and compassionate probate attorney can ease the burden and help families move forward with greater clarity and peace of mind.

The probate process can feel overwhelming—especially when it is unfamiliar and you are still mourning. That stress is often intensified when a loved one (the decedent) passed away without a will or estate plan to clearly express their wishes. Whether you are navigating the loss of a loved one, settling an estate, planning ahead for your own future, or addressing a guardianship or conservatorship matter, you do not have to face it alone. A knowledgeable probate and estate planning attorney can provide the guidance and support you need. To learn how we can help, contact The Law Office of Kimberly J. Webb, PLLC to schedule a consultation.

ESTATE PLANNING

Every adult should have an estate plan, regardless of the size of their estate or their family structure. Without one, your property will be distributed according to Michigan law, which may not reflect your personal wishes. If you have minor children, an estate plan also allows you to name a guardian to care for them if the other parent is unable to do so.

Working with an estate planning attorney ensures your wishes are clearly documented in legally binding instruments, helping to prevent misunderstandings and disputes among loved ones. Depending on your goals and circumstances, your estate plan may include a Last Will and Testament, a trust, or both. Estate planning also involves preparing for the possibility that illness or injury may leave you unable to manage your own affairs.

Incapacity planning allows you to choose, in advance, who will make personal, financial, and medical decisions for you if you become unable to do so yourself. This planning often includes a Durable Financial Power of Attorney, which authorizes a trusted individual to manage your financial affairs. You should also consider executing a Patient Advocate Designation (PAD), which appoints someone to make medical decisions on your behalf. An experienced estate planning attorney will take the time to understand your needs and help you craft a plan that reflects your values and priorities.

When no incapacity plan is in place and an individual becomes unable to manage their personal or financial affairs, family members may need to petition the probate court for a guardianship or conservatorship. A guardian is responsible for personal and medical decisions, while a conservator manages financial matters. Our firm assists individuals seeking guardianship or conservatorship for a loved one, as well as those who may oppose such appointments. We also counsel appointed guardians and conservators on fulfilling their legal duties responsibly and in compliance with court requirements.
